TICKET SALES GENERAL TERMS AND CONDITIONS

1. Definition of Terms
   1.1 In these General Terms and Conditions, the following terms (in both the singular and plural) shall have the following meanings:

'General Terms and Conditions', the General Terms and Conditions of Ticket Sales of Stichting Eilandmarketing Goeree-Overflakkee

‘Location’, the place where the activity is held;
‘Organiser’, the party responsible for organising the activity;

‘Agreement’, the agreement between the Goeree-Overflakkee Island Marketing Foundation and the customer for the purchase and delivery of tickets;

‘Ticket’, the admission ticket to an activity.

1. Applicability
   1. The following General Terms and Conditions apply to all offers, orders and agreements of the Goeree-Overflakkee Island Marketing Foundation. Tickets purchased via the Goeree-Overflakkee Island Marketing Foundation’s online shop are hereinafter referred to as ‘Tickets’.
   2. The agreement is also subject to the organiser’s General Terms and Conditions, as well as the General Terms and Conditions of the venue operators. In the event of any conflict between the provisions of the agreement or these General Terms and Conditions and the aforementioned terms and conditions, the provisions of the agreement or these General Terms and Conditions shall prevail. Copies of the General Terms and Conditions of the venue operators or the organiser are available on request from the operators of the relevant venues or from the organiser.
   3. By accepting an offer or placing an order, you accept the applicability of these General Terms and Conditions.
   4. Any deviation from the provisions set out in these Terms and Conditions may only be made in writing, in which case the remaining provisions shall remain in full force and effect.
   5. All rights and claims, as stipulated in these General Terms and Conditions and in any further agreements for the benefit of the Goeree-Overflakkee Island Marketing Foundation, are likewise stipulated for the benefit of intermediaries and other third parties engaged by the Goeree-Overflakkee Island Marketing Foundation.
   6. All offers made by the Goeree-Overflakkee Island Marketing Foundation and its partners are non-binding and subject to availability.
   7. The Agreement is concluded once the customer has purchased one or more Tickets via the Goeree-Overflakkee Island Marketing Foundation.
   8. The Goeree-Overflakkee Island Marketing Foundation is entitled to verify (or have verified) the accuracy of the details provided by the customer. Providing incorrect or incomplete details may result in the Agreement not being concluded and/or the Tickets not being dispatched.
   9. Stichting Eilandmarketing Goeree-Overflakkee is entitled to refuse orders or to attach certain conditions to the delivery, if necessary without giving reasons. The contract is concluded at all times subject to the resolutive condition that Stichting Goeree-Overflakkee does not accept the order. If an order is not accepted, the Goeree-Overflakkee Island Marketing Foundation will notify the customer in writing (by email) within 3 working days of receiving the order.

1. Prices/offers
   1. All offers from the Goeree-Overflakkee Island Marketing Foundation are subject to change, and the Goeree-Overflakkee Island Marketing Foundation expressly reserves the right to amend prices, particularly where required by (statutory) regulations.
   2. All prices are quoted in euros, inclusive of VAT.
   3. In all cases, these are promotional prices. These prices are valid for a specific period, whilst stocks last. No claim may be made to these prices either before or after the specified period.
   4. The Goeree-Overflakkee Island Marketing Foundation cannot be held liable for price listings that are manifestly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.
   5. The Goeree-Overflakkee Island Marketing Foundation expressly reserves the right to change the prices of Tickets. In the event of limited availability of an offer, the Goeree-Overflakkee Island Marketing Foundation has the right, as soon as the offer is no longer available, to re-offer the same Tickets at a higher price, without the customer being able to claim the earlier (lower) price.
   6. Payment may be made using one or more of the methods indicated during the ordering process. Further (payment and ordering) conditions may be attached to the order. In the event of technical faults of any kind as a result of which payments cannot be processed and/or authorised, or cannot be processed correctly or in a timely manner, the Goeree-Overflakkee Island Marketing Foundation shall not be liable.
   7. If the customer defaults on any payment, the Goeree-Overflakkee Island Marketing Foundation is entitled to suspend the (performance of) the agreement.
   8. The reversal of a payment by the Goeree-Overflakkee Island Marketing Foundation does not release the customer from their obligation to pay and to accept the goods or services.
   9. If Stichting Eilandmarketing Goeree-Overflakkee incurs judicial or extrajudicial debt collection costs in order to recover the amount owed by the customer, these shall be borne by the customer, subject to a minimum charge of twenty-five (25) euros.

1. Use of Tickets issued by the Goeree-Overflakkee Island Marketing Foundation
   1. Tickets cannot be returned or exchanged and lose their validity upon expiry of the validity date stated on them.
   2. Ticket holders must present their tickets at the organiser’s first request, even after entering the event. The event organiser also reserves the right to ask for proof of identity.
   3. It is prohibited to use tickets for commercial purposes without having obtained written permission from the organiser of the event or the Goeree-Overflakkee Island Marketing Foundation.
   4. Each ticket may only be used once. Copying or reusing a ticket is a criminal offence. Any misuse will be reported to the police.

1. Cancellation and refunds
   1. An organiser has the right to reschedule or cancel an activity. Should this occur, the Goeree-Overflakkee Island Marketing Foundation will endeavour to find a suitable solution. If an activity is cancelled or rescheduled, the Goeree-Overflakkee Island Marketing Foundation will do its best to notify you as soon as possible. However, we cannot guarantee that you will be notified before the start of the activity and accept no liability for any costs incurred.
      5.2 Before confirming your booking, always check carefully that you have booked the correct tickets. The Goeree-Overflakkee Island Marketing Foundation is under no obligation to accept returns or exchange tickets once they have been sold.
      5.3 The Goeree-Overflakkee Island Marketing Foundation is not liable for compensation or a refund of the admission fees in the event of any cancellation of an activity by the Organiser or the owner of the Venue. If and to the extent that the Organiser decides to refund admission fees and engages the Goeree-Overflakkee Island Marketing Foundation for this purpose, the refund of admission fees demonstrably paid to the Goeree-Overflakkee Island Marketing Foundation-Overflakkee may be processed via the Goeree-Overflakkee Island Marketing Foundation
   2. Stichting Eilandmarketing Goeree-Overflakkee shall under no circumstances be obliged to reimburse more than the Admission Fees. This means, amongst other things, that no compensation will ever be paid for any additional costs incurred by the Client for services provided by the Organiser or, on behalf of the Organiser, by the Goeree-Overflakkee Island Marketing Foundation. In such cases, the Goeree-Overflakkee Island Marketing Foundation shall never accept liability for any other direct or indirect costs and/or expenses incurred.

1. Payments
   The Goeree-Overflakkee Island Marketing Foundation accepts iDEAL and PayPal payments. Only once the payment has been approved will you see a confirmation on the screen that your order is final.

1. Delivery
   1. The purchase will be delivered immediately upon receipt of the order in the form of an email. The purchase confirmation will also be displayed on the customer’s computer screen once payment has been made.

1. Retention of title
   Ownership of the tickets supplied will only be transferred once you have settled all amounts owed to the Goeree-Overflakkee Island Marketing Foundation under any agreement. The risk relating to the tickets passes to you at the time of delivery.

1. Advertisements and liability
   1. You are obliged to check, upon delivery, whether the tickets comply with the terms of the agreement. If this is not the case, you must notify the Goeree-Overflakkee Island Marketing Foundation in writing, stating your reasons, as soon as possible and in any event within three (3) days of delivery, or at least after it was reasonably possible to establish this.
   2. If it is established that the tickets do not comply with the agreement, Stichting Eilandmarketing Goeree-Overflakkee may, at its discretion, either replace the tickets in question with new ones upon their return or refund the amount paid for them.
   3. Stichting Eilandmarketing Goeree-Overflakkee is not responsible and gives no guarantee whatsoever regarding (access to) the activity, the organisation of the activity, the quality and content of the activity, nor for the conduct of affairs in and around the Venue, and accepts no liability whatsoever in this regard.
   4. The Goeree-Overflakkee Island Marketing Foundation cannot under any circumstances be held liable for damage resulting from death, injury, accidents, harm, loss, damage or theft suffered by the Client during or as a result of a visit to the activity or the Venue.

1. Electronic communication and evidence
   1. The Goeree-Overflakkee Island Marketing Foundation shall not be liable for any misunderstandings, distortions, delays or the failure of data and messages to be transmitted correctly resulting from the use of the internet or any other means of communication in the exchange between the customer and the Goeree-Overflakkee Island Marketing Foundation (or third parties engaged by the customer), the Goeree-Overflakkee Island Marketing Foundation shall not be liable.
   2. The records of the Goeree-Overflakkee Island Marketing Foundation shall constitute full proof of the existence, content and performance of the agreement with the customer in any legal proceedings, unless the party claiming that the evidence is unreliable provides evidence to the contrary.

1. Force majeure
   1. Without prejudice to its other rights, in the event of force majeure, the Goeree-Overflakkee Island Marketing Foundation shall be entitled, at its discretion, to suspend the fulfilment of your order or to terminate the contract without judicial intervention, by notifying you of this in writing, and without the Goeree-Overflakkee Island Marketing Foundation being liable to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.
   2. Force majeure is understood to mean any failure which cannot be attributed to the Goeree-Overflakkee Island Marketing Foundation, as it is not due to its fault and is not for its account either by virtue of the law, a legal act or generally accepted commercial practice.

1. Special provisions, liability
   1. The purchaser of a ticket supplied by the Goeree-Overflakkee Island Marketing Foundation must conduct themselves as a well-behaved and orderly visitor at events and comply with instructions issued by or on behalf of the organiser of the event they are attending, as well as those issued by the competent authorities.
   2. Stichting Eilandmarketing Goeree-Overflakkee shall not be liable for any refusal by the organisers of an event or the public authorities to admit the purchaser of a ticket supplied by Stichting Eilandmarketing Goeree-Overflakkee to an event due to acts and/or omissions on the part of the purchaser.
   3. The purchaser of a ticket attends an event at their own risk. Stichting Eilandmarketing Goeree-Overflakkee shall not be liable for any damage suffered by the purchaser whilst travelling to or from the event or whilst attending it.
   4. The purchaser of a ticket supplied by the Goeree-Overflakkee Island Marketing Foundation-Overflakkee must familiarise themselves with any instructions given by or on behalf of the organiser of the activity or the competent authority, as well as with any changes relating to the activity, such as the start time and the like. Stichting Eilandmarketing Goeree-Overflakkee is under no obligation to provide further information on this matter to the purchaser of a ticket.

 

1. Miscellaneous
   Should one or more of the provisions of these Terms and Conditions or any other agreement with the Goeree-Overflakkee Island Marketing Foundation be found to be in breach of any applicable legal provision, the provision in question shall be deemed void and shall be replaced by a new, legally permissible and comparable provision to be determined by the Goeree-Overflakkee Island Marketing Foundation.
